One of the firm’s largest practice areas is products liability defense, with over 40 attorneys specializing in the defense of product manufacturers. For the last twenty years, Clark, Thomas & Winters has developed a reputation as one of the leading regional and national firms in the field of products liability defense. During this time, we have represented our foreign and domestic clients in thousands of individual lawsuits across the United States.
The Clark, Thomas & Winters’ products liability section defends product manufacturers, distributors, and retailers in state and federal trial and appellate courts and in state administrative agency actions. Attorneys in the section have served as regional counsel for companies in pharmaceutical and medical device cases. The section also has handled significant “mass tort” litigation involving vaccines, silicone gel breast implants, contraceptive devices, diet drugs, thimerosal, PPA, antidepressants, and hormone replacement therapy products.
Members of the section have defended cases and supervised local counsel not only throughout Texas but in Louisiana, Arkansas, Oklahoma, Florida, Pennsylvania, Missouri, Kansas, New Mexico, Colorado, Wyoming, Montana, Ohio, Utah, Minnesota, Arizona, Mississippi, and South Dakota. The section includes attorneys licensed to practice in California, New Mexico, Pennsylvania, and Oklahoma as well as Texas. While many lawyers in the firm handle appeals, our products liability appellate law specialists are also often asked to assist in appeals of cases tried by other firms.
Members of this section are also called upon to represent these clients in a multitude of complex cases in addition to traditional products liability cases, including class action certification proceedings, the defense of trade secret status for nationally known products, open records proceedings, and complex insurance defense cases. This section is on the “cutting edge” of product liability litigation, and members of the section are active in national and local defense organizations. Many of these attorneys have made presentations at the Defense Research Institute (DRI) and Product Liability Advisory Council, Inc. (PLAC) seminars in addition to preeminent legal conferences in Texas and have written papers and law review articles on emerging products liability issues.
